These Terms and Conditions (“Terms”) govern your access to and use of the mobile application (“App”) provided by Your Pet’s Piece of Mind, Inc. (“Company,” “we,” “our,” or “us”). By downloading, installing, or using the App, you (“User,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, you must not use the App.

 

1. ELIGIBILITY

You must be at least 18 years old to use the App. By using the App, you represent that you are legally capable of entering into binding agreements.

 

2. LICENSE AND USE OF THE APP

- We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App solely for personal, non-commercial purposes.

- You may not:

- Copy, modify, distribute, sell, or lease any part of the App.

- Reverse engineer, decompile, or attempt to extract the source code.

- Use the App for unlawful purposes or in violation of applicable law.

 

3. USER RESPONSIBILITIES

You agree to:

- Provide accurate and current information when using the App.

- Be responsible for maintaining the confidentiality of your account credentials.

- Use the App in compliance with these Terms and all applicable laws.

 

4. USER CONTENT

- You may enter or upload information about your pets or other data (“User Content”).

- You retain ownership of your User Content, but you grant us a worldwide, royalty-free, sublicensable license to use, reproduce, analyze, and share your User Content for the purposes of operating, improving, and promoting the App, conducting research, and as otherwise described in our Privacy Policy.

- You represent that you have the right to provide such User Content and that it does not infringe the rights of any third party.

 

5. FEES AND PURCHASES

If the App offers paid features or subscription services:

- You agree to pay all applicable fees and charges.

- All payments are processed through Apple App Store or Google Play and are subject to their respective terms.

- Fees are non-refundable except as required by law or by the applicable app store’s refund policies.

- Current Subscription Options:

1. Free: This gives access to basic app features.

2. Premium: This gives access to all app features.

3. Education Plus: This will provide a code to give users full access to Pet Parent Educators (petparenteducators.com), which is a 3rd party site.

 

There is NO difference in data use between free, premium, and education plus subscription versions.

 

6. INTELLECTUAL PROPERTY

- All rights, titles, and interests in and to the App, including but not limited to text, graphics, trademarks, logos, and software, are owned by or licensed to the Company.

- Nothing in these Terms grants you any ownership rights in the App.

 

7. PROHIBITED CONDUCT

You agree not to:

- Use the App in a way that could damage, disable, or impair it.

- Interfere with or disrupt the App’s security or networks.

- Upload viruses, malware, or harmful code.

- Use the App to harass, abuse, or harm others.

 

8. TERMINATION

We may suspend or terminate your access to the App at any time, without prior notice, if you violate these Terms or if we discontinue the App.

 

9. DISCLAIMERS

- The App is provided on an “AS IS” and “AS AVAILABLE” basis.

- We make no warranties or representations, express or implied, regarding the App, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

 

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.

- Our total liability to you for any claim shall not exceed the greater of (a) $50 USD or (b) the total amount you paid us in the twelve (12) months preceding the claim.

 

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Company, its affiliates, and their respective officers, employees, and agents from any claims, damages, losses, or liabilities arising from your use of the App or violation of these Terms.

 

12. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed under the laws of the State of [Insert State], without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in the state of Georgia, USA, except where prohibited by law.

 

13. CHANGES TO TERMS

We may revise these Terms at any time. If material changes are made, we will provide notice within the App. Continued use of the App after such changes constitutes acceptance of the revised Terms.
