This Privacy Policy (“Policy”) describes how Your Pet’s Piece of Mind, Inc. (“Company,” “we,” “our,” or “us”) collects, uses, shares, and safeguards information in connection with the use of our mobile application (the “App”), available on Apple iOS and Google Android platforms.

By downloading, accessing, or using the App, you (“User,” “you,” or “your”) acknowledge that you have read and understood this Policy and agree to its terms. If you do not agree, you must not use the App.

1. INFORMATION WE COLLECT

We may collect the following categories of information when you use the App:

- Personal Identifiable Information (“PII”): Name, email address, phone number, account credentials, payment details, and other identifiers you voluntarily provide.

- Pet Information: Data related to your pet(s), including health, behavior, and medical records.

- Device Information: IP address, operating system, device identifiers, browser type, crash reports, and usage analytics.

- Geolocation Data: Precise or approximate location data when you enable such features.

- Research Data: Data generated through your usage of the App, which may be anonymized, aggregated, and analyzed for research purposes. This is data collected in the app during assessments, resource use, or medication/seizure log creation.

2. LEGAL BASIS FOR PROCESSING (if applicable under GDPR/International Law)

Where required by law, we process your personal data under the following legal bases:

- Consent: When you affirmatively agree to data collection or sharing.

- Contractual Necessity: To provide services requested by you.

- Legitimate Interests: For research, analytics, and product development using Pet Data and research Data.

- Legal Obligation: To comply with applicable laws and regulations.

 

3. USE OF INFORMATION

We use the collected information for the following purposes:

- To provide and maintain the functionality of the App.

- To improve, personalize, and enhance user experience.

- To conduct internal research and product development.

- To conduct external research, using Pet Data and Research Data, for pet health systems, which may include working with external partners such as research groups, universities/colleges, private/public veterinary practices, privately owned companies, commercial partners, and non-profit entities.

- To perform analytics, including medical and behavioral studies of pets and the technology use of pet owners. Pet data and Research data will be used primarily for this purpose. PII, device, and/or geolocation data will only be used if you are given the chance to “opt in”.

- To deliver targeted content and advertising.

- To comply with applicable law and enforce our Terms of Service.

- There is NO difference in data use between free, premium, and education plus subscription versions.

4. DISCLOSURE AND SALE OF INFORMATION

- Research Use: We may anonymize and aggregate data for use in academic, scientific, and commercial research. While many individual studies will have opt-in options through the App, all Pet data and research data can be used for research, every reasonable effort made to anonymize human data before research use, if an opt-in is not provided.

- Third-Party Vendors: With your consent, where required, we may share or sell certain information to advertisers, analytics providers, research teams, and commercial partners.

- Legal Compliance: We may disclose information if required by law, subpoena, or governmental request.

- Business Transactions: Your information may be transferred in connection with a merger, acquisition, financing, or sale of assets.

- There is NO difference in data use between free, premium, and education plus subscription version.

5. RETENTION OF DATA

We will retain personal information only as long as necessary for the purposes described herein, unless a longer retention period is required or permitted by law. Research data that has been anonymized or aggregated may be stored indefinitely.

 

6. DATA SECURITY

We employ reasonable technical, administrative, and physical safeguards designed to protect your information from unauthorized access, use, alteration, or disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

 

7. USER RIGHTS AND CHOICES

Depending on your jurisdiction, you may have the following rights:

- The right to access, correct, or delete your information.

- The right to opt out of targeted advertising or the sale of personal data.

- The right to withdraw consent for the processing of certain information, such as location data.

- The right to request information regarding categories of data disclosed to third parties.

8. CHILDREN’S PRIVACY

The App is not directed toward individuals under the age of thirteen (13) in the United States (or sixteen [16] in certain jurisdictions). We do not knowingly collect personal information from children without verifiable parental consent. If we become aware that a child has provided us with personal information, we will promptly delete it.

 

9. THIRD-PARTY SERVICES

The App may contain links to, or integrate with, external services or third-party applications. This Policy does not govern such third parties, and we are not responsible for their privacy practices. We encourage you to review their policies before engaging with them.

 

10. INTERNATIONAL TRANSFERS

If you access the App from outside the United States, please note that your data may be transferred to, stored in, and processed in the United States, where privacy laws may differ. By using the App, you consent to such transfer.

 

11. CHANGES TO THIS POLICY

We reserve the right to update or modify this Policy at any time. If material changes are made, we will notify you by updating the “Effective Date” above and, where required by law, by providing notice through the App. Your continued use of the App after changes become effective constitutes acceptance of the revised Policy.
